Terms of Service

1. Eligibility

You must be at least 18 years of age to use our Site and to receive most of our services. Services for individuals under 18 are provided only with the consent of a parent or legal guardian and only where appropriate and permitted by Virginia law. Some services have additional age, health, or medical history requirements; we will inform you during your consultation if a service is not appropriate for you.

2. About our services

Colonial provides medical aesthetic services (including injectables, laser, skin treatments, and related care) and functional medicine services (including hormone therapy, medical weight loss, IV therapy, and wellness injections). All services are provided by licensed clinicians and licensed estheticians in accordance with Virginia law.

Medical disclaimer. Information provided on our Site is for general informational purposes only. It is not medical advice and is not a substitute for consultation with a licensed healthcare provider. The decision to proceed with any treatment is made between you and the Colonial clinician who evaluates you during your consultation. Outcomes vary by individual and cannot be guaranteed.

Consultations. Many of our services require a consultation before treatment. During your consultation, we will review your health history, discuss your goals, and determine whether a treatment is appropriate. We reserve the right to decline to provide a service if, in our professional judgment, it is not appropriate for you.

3. Booking, cancellations, and no-shows

Booking. Appointments may be booked through our scheduling partner (OptiMantra) at the link on our Site, or by contacting us by phone or text at 757-585-4162.

Cancellations. We ask that you cancel or reschedule as early as you can, so we can offer the time to another client. If you are not sure how much notice we need, call or text us at 757-585-4162 and we will tell you.

Late cancellations and no-shows. We may charge a late cancellation fee for appointments cancelled on short notice, and a no-show fee for appointments missed without notice. We will tell you if a fee applies before it is charged.

Late arrivals. If you arrive well after your scheduled time, we may need to shorten or reschedule your appointment so that the clients booked after you are not delayed.

4. Payment and pricing

Pricing for services is provided during your consultation or upon request. Payment is due at the time of service unless otherwise agreed in writing.

Prices are subject to change. The price quoted to you at the time of your appointment will apply to that appointment.

We do not file insurance for aesthetic services.

5. Beauty Bank Membership

If you enroll in the Beauty Bank Membership, additional terms apply:

• The Beauty Bank Membership requires a 12-month commitment.
• Monthly membership fees of $175 are automatically charged on the day of each month corresponding to your enrollment date .
• Each monthly payment is credited to your personal Colonial account ("Beauty Bank") and may be used toward any service or retail product at Colonial.
• Banked funds do not expire while your membership is active.
• Members receive 10% off treatments, 15% off skincare, and 15% off wellness injections during active membership.
• Member discounts cannot be combined with other promotions or special offers.
• Memberships are non-transferable and may be used only by the named member.
• After the initial 12-month commitment, you may cancel your membership with 30 days' written notice (email to colonialaesthetic@gmail.com).
• Early cancellation during the initial 12-month commitment requires 60 days' written notice and an early termination fee equal to the remaining monthly fees for the commitment period.
• Colonial may modify membership terms with advance notice to members.

These membership terms are also presented at the point of enrollment and are part of your membership agreement.

6. Informed consent

Many of our services require you to read and sign a treatment-specific informed consent form before treatment. These consent forms describe the procedure, the expected outcomes, the risks and side effects, alternatives, and aftercare instructions. Your signature on a consent form indicates that you have read it, had an opportunity to ask questions, and agreed to proceed. Consent forms control with respect to the treatments they describe.

7. Photography and use of images

We may, from time to time, request your written permission to photograph treatment results for clinical documentation and, separately, for marketing or educational purposes. Any use of your images for marketing or public-facing purposes requires your separate, written authorization, which you may withdraw at any time. We do not use client images on our Site or in marketing materials without specific written authorization.

8. Right to refuse service

Colonial reserves the right to refuse, discontinue, or decline to provide service to any person where, in our professional judgment, the service is not appropriate or where the safety, dignity, or comfort of clients, staff, or other parties is at risk.

9. Intellectual property

All content on our Site — including text, images, graphics, logos, and design elements — is the property of Colonial Aesthetics & Wellness or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.

The names "Colonial Aesthetics & Wellness," "Beauty Bank," and our logos are our trademarks and may not be used without permission.

10. Third-party services

Our Site uses third-party services, including but not limited to:

• Wix (website hosting and platform)
• OptiMantra (appointment scheduling and patient management)
• Google (analytics, maps)
• Social media platforms (Instagram, Facebook)

Your use of these third-party services is governed by their own terms and privacy policies. We are not responsible for the practices of third-party services.

11. Disclaimer of warranties

To the maximum extent permitted by law, our Site and the information on it are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Treatment outcomes vary by individual and depend on factors including but not limited to your health, age, genetics, lifestyle, and adherence to aftercare instructions. We do not guarantee specific results.

12. Limitation of liability

To the maximum extent permitted by Virginia law, in no event shall Colonial, its owners, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Site or services. Our total liability arising out of or related to these Terms or our services shall not exceed the amount you paid us for the specific service giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Colonial and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms or your violation of any law or the rights of any third party.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or our services shall be resolved in the state or federal courts located in the Commonwealth of Virginia, and you consent to the personal jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Significant changes will be communicated through a notice on our Site or, where appropriate, by direct communication. Your continued use of the Site or our services after changes are posted constitutes your acceptance of the updated Terms.

16. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full effect. These Terms, together with our Privacy Policy and any informed consent forms you sign, constitute the entire agreement between you and Colonial with respect to your use of our Site and services.
